1. The service
kailenty is a scheduling platform for teams, native to Microsoft 365 (Outlook, Exchange, and Teams). We may update, improve, or change features over time. We will give reasonable notice of material changes that adversely affect paid plans.
2. Accounts and organisations
You are responsible for the activity that happens under your account and workspace, for keeping your credentials secure, and for ensuring everyone you invite complies with these Terms. Workspace owners and admins control roles, links, and billing.
3. Acceptable use
You agree not to misuse the service. In particular, you will not:
- Collect or process data you do not have the right to collect or process.
- Attempt to disrupt, reverse engineer, or gain unauthorised access to the service.
- Use the service to store or transmit unlawful, infringing, or harmful content.
- Exceed the seat or usage limits of your plan through circumvention.
4. Plans and billing
The Free plan is available at no charge for solo use. Paid (Pro) plans are billed in advance per active seat on a monthly basis through our payment processors. Fees are exclusive of taxes (such as VAT) unless stated otherwise. See the Refund Policy for cancellation and refund terms.
5. Customer data and ownership
You retain all rights to the data you submit (“Customer Data”). You grant us a limited licence to host and process Customer Data solely to provide the service. Our processing of personal data is described in the Privacy Policy and Data Processing Addendum.
6. Service availability
We work to keep the service available and reliable but do not guarantee uninterrupted access. Scheduled maintenance and incidents are communicated through our usual channels.
7. Disclaimers and liability
The service is provided “as is” to the extent permitted by law. To the maximum extent permitted by applicable law, Digital David AG’s aggregate liability is limited to the fees paid for the service in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.
8. Termination
You may stop using the service at any time. We may suspend or terminate access for a material breach of these Terms. On termination, you may export Customer Data for a reasonable period before deletion.
9. Governing law
These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. To the extent permitted by law, the courts of Frankfurt am Main, Germany have jurisdiction over disputes.
